GENERAL TERMS 

By using artoonsinn.com or any of its sub-domains, you, the user, agree to comply with and be bound by the following terms of use. After reviewing the following terms and conditions thoroughly, if you do not agree to the terms and conditions, please do not use the site.   1. Acceptance of Agreement. You agree to the terms and conditions outlined here with respect to our site and this Agreement supersedes all prior or contemporaneous agreements, representations, warranties and understandings with respect to the Site, the content, services provided by or listed on the Site, and the subject matter of this Agreement. This Agreement may be amended by us at any time and at any frequency without specific notice to you. The latest Agreement will be posted on the Site, and you should review this Agreement prior to using the Site.
  2. Copyright.The content, organization, graphics, design, and other matters related to the Site are protected under applicable copyrights and other proprietary laws, including but not limited to intellectual property laws. The copying, reproduction, use, modification or publication by you of any such matters or any part of the Site is strictly prohibited, without our express prior written permission.
  3. Deleting and Modification. We reserve the right in our sole discretion, without any obligation and without any notice requirement to you, to edit or delete any documents, information or other content appearing on the Site, including this Agreement.
  4. Limits. All responsibility or liability for any damages caused by viruses contained within the electronic file containing the form or document is disclaimed. We will not be liable to you for any incidental, special or consequential damages of any kind that may result from the use of or inability to use the site. We do not hold responsibility for the loss of data due to technical glitches.
  5. Third-Party Website. All rules, terms and conditions, other policies (including privacy policies) and operating procedures of third-party linked websites will apply to you while on such websites. We are not responsible for the content, accuracy or opinions expressed in such Websites, and such Websites are not investigated, monitored or checked for accuracy or completeness by us. The inclusion of any linked Website on our Site does not imply approval or endorsement of the linked Website by us. This Site and the third-party linked websites are independent entities and neither party has authority to make any representations or commitments on behalf of the other. If you decide to leave our Site and access these third-party linked sites, you do so at your own risk.
  6. Copyright Infringement. As ArtoonsInn asks others to respect its intellectual property rights, it respects the intellectual property rights of others. If you believe that material located on or linked to by ArtoonsInn violates your copyright, you are encouraged to notify ArtoonsInn. ArtoonsInn will respond to all such notices, including as required or appropriate by removing the infringing material or disabling all links to the infringing material. This Agreement does not transfer from ArtoonsInn to you or any third party intellectual property, and all right, title and interest in and to such property will remain (as between the parties) solely with ArtoonsInn.
  7. 7. By providing your email address or subscribing to ArtoonsInn, you give us your consent and permission to send you regular updates about our services, offers, information, updates, and company. If you wish to unsubscribe, you may request to and/or unsubscribe from ArtoonsInn.
  8. 8. You understand that you stand responsible for complying and agreeing to the website policies and Terms and conditions of ArtoonsInn.
  9. 9. ArtoonsInn retains the right to use its clients’ name/s and their content, works shared on or created at ArtoonsInn, and to market and promote our services.
  10. Log Information
    Like most online service providers, we collect information that web browsers, mobile devices, and servers typically make available, such as the browser type, IP address, unique device identifiers, language preference, referring site, the date and time of access, operating system, and mobile network information.
  11. Location Information
    We may determine the approximate location of your device from your IP address. We collect and use this information to, for example, calculate how many people visit our services from certain geographic regions. We may also collect information about your precise location via our mobile apps (when, for example, you post a photograph with location information) if you allow us to do so through your mobile device operating system’s permissions.
  12. Cookies
    A cookie is a string of information that a website stores on a visitor’s computer, and that the visitor’s browser provides to the website each time the visitor returns. Pixel tags (also called web beacons) are small blocks of code placed on websites and emails. Automattic uses cookies and other technologies like pixel tags to help us identify and track visitors, usage, and access preferences for our Services, as well as track and understand email campaign effectiveness and to deliver targeted ads.

General terms apply to all the ArtoonsInn Websites.

WRITERS.ARTOONSINN.COM | Room 8 | Writers Room

  • You understand and agree that you are solely responsible for your submissions and the consequences of posting your content.
  • With regard to the content you post and/or submit to Writers.artoonsinn.com, you represent and warrant that
    a) You are the rightful owner or you have neccesary licenses, rights, consents and/or permission to share the content and grant us rights to publish your content.
    b) Your content will not infringe or violate the rights of any third party (including intellectual property rights); slander, defame or libel or invade an individual’s privacy, publicity or other rights of a person; violate any applicable law.
  • You hereby agree that writers.artoonsinn.com has the sole right to modify or remove the contents of the website without any prior notice. In addition, you agree that writers.artoonsinn.com holds the right to publish content on its subsidiaries, affiliates, and third-parties in whatever form under your name, including but not exclusive to podcasts, celluloid adaptations, animated videos, etc ensuring you have sole intellectual rights to the content.
  • By submitting your content to writers.artoonsinn.com, you declare that the content is plagiarism-free. ArtoonsInn reserves the royalty-free right to publish, modify and distribute the submitted content under your name on the web and social media.
  • By submitting your content to be published on writers.artoonsinn.com you give us permission to include and publish the content if selected, in anthology collections published by ArtoonsInn room9 publications after a written notice to you via email.
  • You agree to abide by the Rules of Writers Room and understand that the breach of rules will result in your being banned from ArtoonsInn.
  • Your content may be subjected to a review by an editorial team and may be edited, reviewed and monitored.
  • You are prohibited from copying and misusing the content in any way.
  • ArtoonsInn holds the complete right to take down any content for whatever reason at its sole discretion.

  • Poetry Parlour conducts and hosts regular activities, of which selected content is published on poets.artoonsinn.com.

ARTOONSINN ROOM9 PUBLICATIONS

  1. The material you are submitting is the Author’s own creative and/or well-researched content and is not co-authored by anyone else unless mentioned.
    2. The submitted manuscript content has not been published as a whole or as portions in printed form or is available online.
    3. The submitted manuscript is not under consideration and/or pending acceptance by any other publishing platforms.
    4. The manuscript does not contain any non-attributed content from any existing source and that all due acknowledgments for content other than the author have been provided with the owner’s permission.
    5. The content in your manuscript does not violate any privacy rights, publicity rights, copyright rights or other rights of any person or entity.
    6. ArtoonsInn Room9 Publications may use the personal details of the Author for correspondence. We do not accept academic or non-English submissions. These submissions will be automatically removed from our systems and you may not hear back from us.
    7. ArtoonsInn Room9 publications guarantee the privacy and intellectual property of the Author and maintain said privacy at all times.
    NOTE: The word Content includes names of person/s, incidents and/or experiences by person/s, quotes, places, images, photographs and but not limited to works of other authors.
    8. ArtoonsInn Room9 Publications offers two types of publishing (Green dot publishing and Standard publishing), out of which if the submission is selected to be published, the author is notified of by email and a mutual Agreement signed online. ArtoonsInn reserves the right to reject a manuscript for whatever reason before the Agreement is signed. However, ArtoonsInn will stand by the terms of the Agreement and in case of a legal issue or cancellation of an author-publisher relationship, the author will be duly notified and all things will be settled diplomatically.
    9. All services and benefits of any package offered by ArtoonsInn for a fee or for free stand valid only throughout the period of a signed Agreement between ArtoonsInn and the client. Services/Benefits offered in a package may be subjected to modifications/additions/removal at any given time on the website without prior notice to the clients who have signed up for a package. The client reserves the right to claim for a benefit/service from ArtoonsInn only if it has been explicitly mentioned in the Agreement, before the expiration of the Agreement.
    10. Service guarantee:
    ArtoonsInn Room9 Publications’ editorial team is committed to providing exceptional, timely, and friendly service.
    The editors ensure that your work is treated confidentially.
    11. Though the editors will take care of every detail, the author is responsible for the accuracy of information/content that is provided for editing.
    12. ArtoonsInn ensures that the author remains in full control of the content/work. We ensure this by:
    -using the author’s own personalized style manual (if available)
    -respecting and following the author’s instructions to the dot
    -respecting and preserving the author’s ‘voice’
    -checking with the author before making major changes
    -using ‘Track Changes’ so that the author is free to accept or reject all changes
    -using ‘Comments’ to explain changes, raise issues, make objections and/or suggestions.
    13. All documents that are received for editing are edited to a high standard. ArtoonsInn’s Editors provide the best possible service to the best of their ability. ArtoonsInn does not guarantee that the written documents are “perfect” or “without error.” ArtoonsInn provides no guarantee that the client’s work will be completely error-free. However, in case of any errors pointed out before publication or during the trial-printing phase, ArtoonsInn will ensure and make necessary amendments subsequently.
    14. You acknowledge and accept that ArtoonsInn retains rights to set sales prices lower than the MRP of the published book. This may be done for promotional purposes, for a period of time. ArtoonsInn may or may not seek your permission for such discounts/promotions/seasonal offers.

ARTOONSINN SHOP

  1. Registration. As a condition to using ArtoonsInn Shop, the User may be required to create an account with us. ArtoonsInn reserves the right to refuse registration of or cancel a User in its discretion.
  2. SERVICE CANCELLATION POLICY: We allow cancellations of a service you have requested for from ArtoonsInn, if the service has not been commenced, for a full refund minus payment processing fees, if applicable.
  3. PRODUCT CANCELLATION POLICY: We allow cancellations of an order you have placed at ArtoonsInn Shop, if the order has not been shipped, for a full refund minus payment processing fees, if applicable.
  4. PRODUCT RETURN POLICY: Defective items may be returned for an exchange, return, refund or upgrade within 7 days from the date you received it.
  5. SHIPPING POLICY: Products ordered at ArtoonsInn in India, are shipped through our courier partners. If our courier partner does not offer their service at the desired location, the products are shipped through the Indian Postal Service. All orders are processed within 3-5 business days. The shipping time mentioned on the website is approximate and delivery is subject to the courier partners. Orders are not shipped or delivered on weekends or holidays. If we are experiencing a high volume of orders, shipments may be delayed by a few days. If there will be a significant delay in shipment of your order, we will contact you via email or phone call. You will receive a Shipment Confirmation email once your order has shipped containing your tracking number(s). The tracking number will be active within 24 hours. Our shipping services are currently restricted to within India.

The Resider Space

  1. 1. Resider Space is provided to artists/residers in random order. The display position of a Resider may be sorted in different ways and displayed anywhere within the room at any given time.

All forms of Art, Artists, and brands that are displayed in the room are authorized and recognized by ArtoonsInn and ArtoonsInn reserves the rights to edit/moderate/remove any form of Art, an Artist’s content or any brand that has been given Residers Space at ArtoonsInn.

Your privacy is critically important to us. At ArtoonsInn, we have a few fundamental principles:

  • We are thoughtful about the personal information we ask you to provide and the personal information that we collect about you through the operation of our services.
  • We store personal information for only as long as we have a reason to keep it.
  • We aim to make it as simple as possible for you to control what information on your website is shared publicly (or kept private), indexed by search engines, and permanently deleted.
  • We help protect you from overreaching government demands for your personal information.
  • We aim for full transparency on how we gather, use, and share your personal information.

ROOM10 – THE GEEKS ROOM

  1. PROJECT TERMS
  • All estimates/quotes are based on our understanding of your requirements and as per the given time-frame. Any changes to the functionality including micro-improvements may incur additional costs accordingly. Please ensure to clarify your requirements clearly with the Project Manager assigned to you.
  • By accepting a quote, you also agree to and accept the terms and conditions of ArtoonsInn. Acceptance can be verbal, by email, payment of Initiation, or signing a quote.
  • Clients must ensure that they have included all requirements in the quotes/proposals/estimates and verify that we have fully understood their requirements. Clients must provide us with clear guidelines along with the flow or specific details they may require. When such details are not provided, we will proceed with our understanding of the requirements and quote accordingly. At a later stage, if a discrepancy arises, it may lead to additional costs to accommodate the changes. Thus, it is essential that you clarify every aspect of your website development and ensure that you have been quoted on the right requirements.
  • Any complexity related to specific tasks must be advised in advance and included in the proposal for costing purposes. We operate in good faith and rely on our clients to disclose the full picture at the time of quotation. Any discrepancy arising due to unclear requirements will not be borne by The Geeks Room.
  • The Geeks Room will make every effort to complete the project/changes in the given timeframe. Reasonable delays are accepted if functionalities are redefined or modified.
  • Delays from the client, may delay the project and proposed timeframes and may incur additional costs.
  • Any bugs (programming errors) reported during or just after the development does not incur additional charges.
  • Any re-work on an already completed task will attract additional charges. Any changes in the design after the design approval will incur additional charges.
  • Any modifications requested during the development or after the Go-Live approval will incur additional charges. All additional work, over and above the estimates is charged separately. Under no circumstances will The Geeks Room be liable for any delays caused by a change in the project description.
  • Website content and all related materials need to be provided to us within the first two weeks of starting the project. Any delays thereafter may delay the project and may incur additional charges if it goes beyond a reasonable timeframe.
  • Our websites are generally tested on PCs and include near recent versions of the following browsers: IE, Firefox, Chrome & Safari. If you require testing to be done on any other browser, please let us know in advance.
  • Please note that at any stage during the project, stalling of the project for over two calendar months will incur INR 500/week administration costs. Furthermore, it may increase the previously approved estimates. If you require the project to be put on hold, please advise us in writing in advance. To put the project on hold without incurring additional charges, we will need the account to be up to date based on the work done. Further details can be discussed if such a situation arises.
  • The Geeks Room software codes (not including open source software) are copyrights of ArtoonsInn. The codes can be handed over for an additional cost for use once all previous invoices are settled, on the condition that the codes are used only for use or modification for re-use for further development for the specified client or subsequent owners of that legal entity. Under no circumstance are the codes to be used for re-selling or duplication purposes.
  • The website or software application will be designed to be deployed on the web, via WordPress.
  • Depending upon the functionalities required, there may be 3rd party components such as Third-Party Payment Gateways, Plugins, Themes or SSL certificates involved in building a website/application. Although The Geeks Room does its best in recognising the suitability of any such component, any unforeseen limitations of 3rd party components are beyond our control.
  • The client must recognize that at times there may be unforeseen circumstances that will delay the development process, particularly with reference to the integration of third-party software. We will try our best to complete the project as agreed in the proposal. As long as it is within a reasonable period, the client agrees not to penalize us for any genuine delay, when every effort to keep the project on the proposed schedule is taken.
  • The Geeks Room is not offering Domain registration services. If the client requires a domain other than the Free domain we offer, it has to be registered separately.
  • Hosting charges are included in the Yearly Plan quotations.
  • Notwithstanding any other provision in the agreement, in consideration of the Customer entering into this agreement with The Geeks Room, upon full payment of any outstanding invoices, The Geeks Room will grant an unconditional license to the Customer to reproduce, publish, communicate, use, exploit, vary, or otherwise deal with 1) the graphics, 2) texts and 3) images used in the published website and associated of form and functionality. This will not include the intellectual property relating to the production of the website including the digital strategies, programming codes, database structures, scripts, forms, themes or functionalities.
  • All communications/correspondences are generally done via emails. It is the client’s responsibility to keep us updated with their relevant email addresses.
  • The Geeks Room may add design tools, plugins, and other applications to fulfill the requirements of clients. Such tools, plugins or any other third party elements, if used, will be informed via email to the client. Any changes or modifications that are made by the client to these elements may lead to loss of data or may even lead to the crashing of the website. The Geeks Room shall not bear any responsibility for such losses, and reworking on the same may incur additional costs upon the client.
  • The services that are provided for each plan or packages are mentioned in detail. The client, however, reserves the right to deny any service/s from the chosen plan. Denying one ore more services, however, will not lower the cost or alter the Plan cost.
  1. BASIC MAINTENANCE PACKAGE TERMS:
  • All maintenance packages are as described in the Plans.

*All Websites ordered under our Plans or Packages are set up on WordPress.

  • Maintenance plans are billed annually. As per your selected plan, the yearly payments may be paid via direct debit or by renewal within the 7 days after a plan’s expiry or earlier.
  • Plans may include 12 months of basic website hosting, email hosting, and DNS hosting.
  • Plans are designed to offer services as briefed in the package. The hours may not be used for projects such as full redesign or major functionality add-ons.

*We usually provide premium themes for all the websites we create on WordPress. When and if you decide on moving from The Geeks Room to any other hosting provider, please note that we won’t be able to update or provide updates further for your website’s theme or plugins you bought from The Geeks Room under GPL license.

  • Plans do notinclude any Digital Strategy, Business Analysis, Solution Architect, SEO, or Digital Marketing work.
  • Support requests need to be sent via email to [email protected]
  • Any urgent tasks will be charged separately.
  • The package may be auto-renewed every year on its anniversary date.
  1. Payment terms:

Yearly maintenance package/plan fees require credit or debit card payment only. No other forms of payment will be accepted.

If the Plan is not renewed within 15 days after expiry, we may terminate our services which may lead to taking the Site down.

There are absolutely no refunds for any fees related to the Yearly maintenance package.

  1. Termination:

In case the Client needs to cancel the auto annual renewal, it can be done from the Client’s account or by getting in touch with us by email at least one month prior to the renewal date.

Ongoing term: For any reason, if the Client decides to terminate an on-going plan, the amount for the rest of the months will not be refunded.

The Geeks Room of ArtoonsInn reserves the right to terminate any benefits of a plan for whatever reason at any time with written notice to the Client.

  1. GENERAL APPROACH

For general website design & development projects we employ the following steps:

  • After quote acceptance/signoff, initiation payment is processed to start the project. As required by the project, the geeks will get in touch with you over your preferred mode of communication to discuss the requirements in detail.
  • Once we have the Site requirements we will have a mock-up for your review within 10 to 15 working days.
  • You can review the design and suggest improvements accordingly. Depending upon your project, generally up to 3 to 5 design modifications can be done within the given estimates.
  • Once the design is finalized and approved, we’ll proceed with the development.
  • Once the site is ready from our end, we generally hand it over to you for further review, test and/or to upload/change contents as necessary.
  • At this stage, we can discuss and set a “Go-Live date” for us to make the website/project live.
  • Your website can be made live within 3 to 5 working days after a Go-Live approval, assuming that the accounts are clear. Kindly note that we require full payment prior to transferring the website to the server.
  • We encourage you to provide all the necessary details, at the start of the project to ensure that our team’s time is efficiently utilized on your project and you do not incur any unnecessary additional costs.
  • You will be kept updated via emails and/or telephone calls as the project demands. However, please do not hesitate to contact us at any time you require a project status. Also, please always keep us updated with your relevant email addresses/contact details.
  • Once the website/application has been made live on the client’s domain, it is their responsibility to take regular full back-ups and to update all components and third-party software unless the Plan or Package offers it.

We consider ourselves to be very flexible and adaptable and approach all requests with a ‘can-do’ attitude. If you require something changed, please feel free to discuss it with us. The Geeks Room will include a ‘Geeks Support’ with admin access as one of the Users of the website, in all plans and packages offered by The Geeks Room. This is in order to provide support, maintenance and updating plugins, tools, etc.

  1. PAYMENT/REFUND TERMS
  • All rates including but not exclusive to fees, monthly/annual plans and charges are subject to change and if so, will be notified a month in advance to the clients by email.

*All prices are quoted in Indian Rupees and are inclusive of Goods and Service Tax unless specified.

  • All invoices are to be processed as per the schedule via your preferred method of payment.
  • There may be surcharges charged for payments made via certain payment methods. Ensure that you discuss your mode of payment with your project manager prior to making the payment.
  • The Final payment must be made prior to the website going live unless it is a Plan or a Package offered by us.
  • Receipt of payment is deemed as acceptance of the quote and/or project and terms & conditions.
  • The Geeks Room reserves the right to negotiate and refund the appropriate portion of the amount paid by the customer towards the requested service. If you cancel your order after making the payment, but the work has not commenced, we will refund 75% of the payment that you have already made. If the order is canceled after the commencement of work, the maximum refund or charge will be 50% of the invoice. There will be no refund or adjustments if cancellation is called when more than 50% of the work has been completed. All cancellations must be received in writing and can be sent via email. Telephone requests on cancellations will not be accepted.
  • Late fees and charges: All outstanding invoices will incur a late payment fee of 10% of the pending amount and an administration fee of Rs.1000 per month, from the due date.

Due date: Is the date on which the payment is due as per the terms on the invoice/proposal/plan.

Outstanding Invoice: An invoice is deemed to be outstanding if the payment is still due after 15 days of the expiry of the due date.

Debt Collection: The client is provided a further 7 days after late payment fee is applied to pay the invoice. Failure to pay will result in the outstanding amount referred to as a debt collector. The Geeks Room will not be liable for any costs or charges associated with the recovery of the outstanding amount. Any charges associated with the recovery of the outstanding amount (debt collectors, administration charges, legal fees) will be referred to the client for processing.

  • If you are late with a payment or have any queries regarding the Invoice, please contact your Project Manager immediately on receiving the invoice or reminder emails.
  • All communications/correspondences are generally done via emails. It is the client’s responsibility to keep us updated with their relevant email addresses.
  • Any payment relating to the domain name registration renewal or hosting or any 3rd party products or service purchased on behalf of the client will have to be paid in full and is non-refundable. In case of all renewal cancellations, we must be notified at least 30 days before the renewal date.
  1. DISPUTES, LIABILITY, AND INDEMNITY

In an event of a dispute, The Geeks Room reserves the right to charge the client in full for the work done as well as for the resources spent in managing the dispute. In such an event, The Geeks Room reserves the right to charge the client without honoring any discounts that were previously honored in good faith. Under no circumstances will The Geeks Room be liable for any damages arising from misrepresentation or misinformation.

The Geeks Room reserves the right to refuse service to any client if these are not aligned with our business operating principles and policies.

The Geeks Room provides its services as is, without any guarantees on security or other issues leading to loss of data, sale or reputation. We ensure to the best of our ability that our systems and servers are protected from hackers, viruses, intruders and other online and offline problems, however, we will not be held liable for any disruption of services if such a situation arises.

Relationship of The Geeks Room with its suppliers, partners, and sub-contractors is of an independent nature. None of the parties have any power, right or authority to interfere or bind the other or assume or create any obligation or responsibility, whether expressed or implied, on behalf of the other or in the other’s name.

Client will indemnify and hold The Geeks Room, its licensors, content providers, service providers, employees, agents, officers, directors, contractors, and sub-contractors (the “Indemnified Parties”) harmless from your breach of any of these Terms And Conditions or any other terms, conditions, policies or procedures herein, including, without limitation, any use of content other than as expressly authorized in these Terms and Conditions. Client agrees that the indemnified parties will have no liability in connection with any such breach or unauthorized use, and you agree to indemnify and hold harmless the Indemnified Parties from any and all resulting loss, damages, judgments, awards, costs, expenses, and attorneys’ fees in connection therewith. You will also indemnify and hold the Indemnified Parties harmless from and against any claims brought by third parties arising out of your use of the information obtained from The Geeks Room.

The Geeks Room will not be liable for any breach of the agreement which is caused by a matter beyond its reasonable control including but not limited to fire, lightning, explosion, war, disorder, flood, earthquake, industrial disputes (whether or not involving their employees), extremely severe weather, or acts of local or central government or other competent authorities.

  1. HOSTING TERMS

Hosting is an annual charge which must be paid in advance for the whole year.

It is the client’s responsibility to renew the hosting in time before the expiry date. Failure to renew in time can lead to loss of files, data, emails, backups, etc. All unpaid hostings are disabled or deleted from the server.

All renewals must be paid by seven working days prior to the expiry date. The Geeks Room will not be responsible for issues relating to the delayed payment.

In case of a malware attack, The Geeks Room reserves the right to delete files on the hosting service without giving any prior notice.

The Geeks Room provides hosting services through The Geeks Room’s cPanel at Bluehost.com.

The Geeks Room provides hosting plans under Shared hosting. If a dedicated IP is required, the client may contact the team to set it up for a pre-discussed monthly fee.

How much disk space and bandwidth is included with my plan?

For packages supporting unmetered disk space or data transfer (bandwidth), we do not have defined limitations. These resources are “unmetered”, meaning you are not billed according to the amount of disk space or bandwidth used. While of course these resources are not infinite, we believe our customers should have all the resources necessary to build an online presence and 99.95% of customers will have more than enough disk space and bandwidth to meet their needs.

That said, we do require all customers to be fully compliant with our Terms of Service and utilize disk space and bandwidth in a manner consistent with the normal operation of a website. While rare, we occasionally constrain accounts utilizing more resources than should be the case in the normal operation of a personal or small business website.

How do you determine “normal” operation?

We regularly examine customer bandwidth and disk space utilization data in a series of statistical analyses and use the results to define “normal”. Although these tests vary from month to month, one thing remains constant: 99.95% of our customers fall into “normal” range. If your account’s bandwidth or disk space utilization causes any concern, you will receive an email asking you to reduce usage. We strive to provide at least 48 hours notice to allow customers to make adjustments before we take any corrective action.

It is very rare for a customer to exceed normal usage while managing a website. Typically, customers only experience issues if they use their accounts for storage (for example large multimedia files) or file sharing. Our hosting services are not intended to support these activities, and in accordance with our Terms of Service your disk space and bandwidth usage must be integrated into the normal operation of a website. We offer various plans that better address high bandwidth and large storage requirements. Please contact us for details.

  1. Cancellation/Termination:

Hosting Cancellation requests must be sent via email one month prior to the expiry of the same. Once the hosting has been renewed, it cannot be canceled and must be paid for the full year.

If the hosting is not paid and renewed before the expiry date, The Geeks Room reserve the right to disable the hosting and all associated services including emails and DNS records. Additional charges will be applicable to re-enable the hosting. The Geeks Room will not be responsible for any loss of data, files, emails, backups, restoration costs, etc.

If a hosting has been canceled/disabled then all files, emails, databases, and backups will be deleted from the server without any notification to the client.

Emails:
All emails are to be downloaded on the client’s computer periodically. Email boxes must be kept within their quota limits. Periodical maintenance may be carried out on the email box and emails older than 6 months are deleted.

Clients must not use the email hosting for inappropriate content and other undesired emails which can result in spamming or infecting the server. Under such circumstances, immediate action will be taken and the required files and data will be deleted without any prior notice.

The Geeks Room offers Plans in coordination with third-party providers. Changes to the third-party provider’s rules and policies may ultimately affect the services we provide or the terms and conditions herein.

  1. DOMAINS

All domain registrations and renewals if registered via The Geeks Room are to be paid in advance.

The expiration of a domain can result in service disruption and loss of domain.

The Geeks Room will not be responsible if a domain expires due to non-payment / late payment of the charges. All payments must be made by seven working days before the expiry date.

It is the client’s responsibility to renew their domain names with us.

All invoices and dues must be paid in full before we release the requested domain name.

  1. INTELLECTUAL PROPERTY

All content of this website is a property of The Geeks Room of ArtoonsInn.com unless otherwise specified. The Geeks Room reserves the right to change the content or policies without any prior notice.

The project related copyrights can be transferred to the client at an additional cost, after the full payment of the project and upon signing the Certificate of Acceptance. The Geeks Room reserves the right to refuse the transfer of ownership if irregular circumstances arise.

Copyrights handed over to the client do not include the rights to re-use the code for another website or re-sell the programming codes for any commercial or non-commercial purposes. In the case of business restructuring or ownership change, ownership of the website may be transferred from one owner to another. New owners are not allowed to re-sell or re-use for any commercial or non-commercial purpose.

“The Geeks Room” is a trademark of ArtoonsInn.com of India, along with the symbol which consists of a house enclosing the letter ‘A’ and also the logo “ArtoonsInn – Where Artists reside”. Clients, Partners, Suppliers, Sub-contractors and any other 3rd party organization or individual are not allowed to use The Geeks Room or ArtoonsInn.com trademarks including the name, logo, and symbol in any way, shape or form without written permission from us.

The Geeks Room Affiliate Program

These Terms and Conditions (the “Affiliate Agreement“) govern the Affiliate Program that is made available by Geeks.artoonsinn.com (“Geeks.artoonsinn.com“, “we” or “us“). These Terms and Conditions represent the whole Affiliate Program agreement and understanding between Geeks.artoonsinn.com and the individual or entity who participates in the Affiliate Program (the “Affiliate“, or “you“).

Please read the below terms carefully as they represent a legally binding agreement between you and Geek.artoonsinn.com. By submitting your application and by your use of the Affiliate Program, you agree to comply with all of the terms and conditions set out in this Affiliate Agreement. Geeks.artoonsinn.com may terminate your Affiliate Account at any time, with or without notice, for conduct that is in breach of this Affiliate Agreement, for conduct that Geeks.artoonsinn.com believes is harmful to its business, or for conduct where the use of the Affiliate Program is harmful to any other party.

  • 2. Referral Tracking

    Geeks.artoonsinn.com will provide the Affiliate with specific Referral Links to link advertisements and other marketing content to Geeks.artoonsinn.com. Geeks.artoonsinn.com will track users who have visited these Referral Links using cookies which expire after 30 days. Only users who make a purchase while the cookie is active will be considered referrals of the Affiliate and recorded as such in the Affiliate Dashboard.

    The Affiliate is not authorized to modify or alter the Referral Links or the cookies in any way. Geeks.artoonsinn.com is not responsible for any tracking or reporting errors that may result from any modifications to the Referral Link or the cookies.

  • 3. Affiliate Fees and Payouts

    A referral will become eligible for payout (“Eligible Referral“) at the end of the next calendar month if it meets all of these criteria:

    1. The referral makes a purchase of a new Website or Hosting Plan with a term that is one year or longer and has paid in full.
    2. The referral’s account remains active and in good standing.
    3. The referral’s account has not had any of its payments refunded, charged back or otherwise reversed.

    All web page error requests (such as 403 errors or 404 errors) will direct traffic to a default Geeks.artoonsinn.com error page. This error page informs visitors that the web page they are looking for cannot be found, and may include, but without limitation to, the following:

    1. Links to additional products and services offered by Geeks.artoonsinn.com.
    2. Advertisements for products and services offered by third-parties.
    3. An internet search engine interface.

    Failure to meet any of these criteria will permanently void the referral and disqualify the referral from any potential payouts.

    The Affiliate is entitled to receive a one-time payment as discussed or mentioned for each active Eligible Referral that is recorded in the Affiliate Dashboard (“Affiliate Fee“). Affiliate Fees will be payable only when the Affiliate has at least 500 INR in his/her Pay balance.

    All Affiliate Fee payments will be payable in Indian Rupees only, except as otherwise determined by Geeks.artoonsinn.com in its sole discretion. Payment will be made through Bank transfer. The Affiliate is responsible for providing Geeks.artoonsinn.com with the full and accurate details that are required to remit the Affiliate Fees and is solely responsible for any delays in payment resulting from its failure to do so.

    Referrals will become void, and any unpaid Affiliate Fees will be forfeited, after 12 calendar months.

    In the event of any activity deemed suspicious by Geeks.artoonsinn.com, Geeks.artoonsinn.com may delay the payment of Affiliate Fees by up to 6 calendar months to verify the relevant transactions. Geeks.artoonsinn.com reserves the right to recalculate, void, or disqualify any referrals or Affiliate Fees in the event of any fraudulent, deceptive, or otherwise illegal activity.

    Referrals for purchases made through Geeks.artoonsinn.com promotional or special offers are not eligible for payout.

  • 4. Advertisements

    Geeks.artoonsinn.com hereby grants the Affiliate a non-exclusive, non-transferable, limited license to use the Geeks.artoonsinn.com logos for the sole purpose of promoting our service within the context of the Affiliate Program. This license will expire upon termination of the Affiliate’s participation in the Affiliate Program.

    The Affiliate may only display advertisements that contain Geeks.artoonsinn.com’s logos or service marks in good taste. The Affiliate may not use Geeks.artoonsinn.com’s logos or service marks in a manner that, in Geeks.artoonsinn.com’s sole discretion, portrays Geeks.artoonsinn.com in a negative light.

    The Affiliate will be solely responsible for its own marketing activities. All marketing activities must be professional and in full compliance with all applicable laws.

    Geeks.artoonsinn.com may, without prior notice, require the Affiliate to remove or modify any advertisements in Geeks.artoonsinn.com’s sole discretion.

  • 5. Termination

    The Affiliate may terminate the Affiliate’s participation in the Affiliate Program with immediate effect by giving the other party written notice of termination.

    Geeks.artoonsinn.com reserves the right to terminate the Affiliate’s participation in the Affiliate Program at any time for conduct that is in material breach of this Affiliate Agreement or for conduct that Geeks.artoonsinn.com, in its sole discretion, deems to be harmful to its business or any third party.

    Upon termination, the Affiliate will lose access to its Affiliate Dashboard and will forfeit all potential or unpaid Affiliate Fees.

  • 6. Relationship of Parties

    Geeks.artoonsinn.com and the Affiliate are independent contractors. Nothing in this Affiliate Agreement will create any partnership, employment, representative, agency, or joint venture relationship between the parties. The Affiliate has no authority to act on Geeks.artoonsinn.com’s behalf.

  • 7. Limitation of Liability

    The Affiliate Program is provided on an “as is” and “as available” basis and the use of the Affiliate Program is at the Affiliate’s own risk. Geeks.artoonsinn.com makes no representations or warranties, either expressed or implied, with respect to the Affiliate Program, or any service or information provided through the Affiliate Program.

    Geeks.artoonsinn.com is not responsible for any damages, injury, or economic loss arising from the use of Affiliate Program. Should any part of the Affiliate Program cause damage or inconvenience to the Affiliate or anyone claiming through the Affiliate, the Affiliate assumes responsibility and the entire cost for them.

    The Affiliate will indemnify and hold harmless Geeks.artoonsinn.com, its directors, officers, employees, agents, subsidiaries, watchers, builders and third parties from and against any losses, damages, liabilities, claims, judgments, settlements, fines, costs and expenses (including reasonable related expenses, legal fees, costs of investigation) arising out of or relating to the Affiliate’s or any third party’s operations or use of the Affiliate Program.

  • 8. Modification

    Geeks.artoonsinn.com may, in its sole discretion, change or modify this Affiliate Agreement at any time, with or without notice. Such changes or modifications shall be made effective for all Affiliates upon posting of the modified Affiliate Agreement to this web address: http://Geeks.artoonsinn.com. The Affiliate is responsible for reading this document from time to time to ensure that its use of the Affiliate Program remains in compliance with this Affiliate Agreement.

    If any modification is unacceptable to the Affiliate, its sole recourse shall be to terminate this Affiliate Agreement. The Affiliate’s continued participation in the Affiliate Program will constitute binding acceptance of such modifications.

  • 9. Miscellaneous

    The Affiliate warrants and represents that he/she is over the age of 19 and is qualified to enter into this Affiliate Agreement.

    The Affiliate warrants and represents that its actions and its participation in the Affiliate Program are in compliance with all applicable laws, rules, regulations, and any requirements of governmental authority at all times. Geeks.artoonsinn.com reserves the right to terminate the Affiliate’s participation in the Affiliate Program if Geeks.artoonsinn.com determines, in its sole discretion, that the Affiliate’s actions or its participation in the Affiliate Program is in violation of any laws, rules, regulations, or any requirements of governmental authority.

    This Affiliate Agreement constitutes the entire understanding between Geeks.artoonsinn.com and the Affiliate. This Affiliate Agreement supersedes any other contracts or understandings between the parties hereto and neither party shall be bound by any statements or representations that are not embodied in this Agreement.

    Any dispute arising in relation to this Affiliate Agreement shall be exclusively resolved in the Courts of the Province of India.

ARTOONSINN AIR

  1. To share your content on ArtoonsInn Air, you hereby agree to have your own user account created at air.artoonsinn.com and provide a photograph of yours and a short intro for your profile.
    2. Registered users may submit and/or contribute content to ArtoonsInn Air at no cost unless otherwise specified by a written agreement.
    3. ArtoonsInn Air reserves the right to distribute and share your content along with associated metadata, images, artwork, texts, photographs, videos, marketing materials or other associated materials.
    4. By submitting content to ArtoonsInn Air, your ascertain and verify that,
    – the content does not violate any agreement, applicable law, the intellectual property (including copyright) of an individual, company or organization, publicity or personality.
    – ArtoonsInn Air will not be responsible to any third party material nor will royalty or other fees be payable to ArtoonsInn Air for the reproduction, distribution, public display, public performance, creation of derivative works or other use of submitted content
    – all content submitted does not contain any objectionable content
    – the content you share does not contain advertisement of any type or self-promotion unless otherwise permission granted by the Watchers of ArtoonsInn
    5. ArtoonsInn Air is under no obligation to share, distribute or publish your content via www.air.artoonsinn.com and reserves complete rights to remove any content from the website at any time for any reason at its sole discretion.
    6. The content you share may be subjected to review by an editorial team and may be monitored, reviewed and/or edited.
    7. By sharing your content with ArtoonsInn Air you grant us the non-exclusive, transferable, royalty-free worldwide license to process your content reasonable to transmit and publish it on our site.
    8. You are prohibited from copying, redistributing, reproducing or misusing of the content shared in ArtoonsInn Air for any reason without the prior written permission from ArtoonsInn.
    9. Trademarks, trade names, logos, domain name and other features of ArtoonsInn Air are the sole property of ArtoonsInn. You are not granted any rights to use any ArtoonsInn Air brand features for commercial or non-commercial purposes. All goodwill and revenue generated from the use of ArtoonsInn AIr will inure solely to ArtoonsInn unless otherwise specified by a written agreement.
